Please read these Terms of Use carefully «From Heart UA" (hereinafter referred to as the "Terms") before using the website of the charitable foundation "From Heart UA" or make charitable contributions to the Foundation online using such a website (hereinafter referred to as the "Site"). These Terms contain important information about your rights and obligations.

By using the Site on which these Terms are posted, you confirm that you have read the Terms, understand their content and agree to comply with these Terms in full. If you do not agree to these Terms, please do not use this Site.

Under the terms "From Heart UA", "Foundation", "we", "us" or "our", which are used in these Terms, means a charitable foundation "From Heart UA" — non-profit Charitable Organization "Charitable Foundation" «From Heart UA», EDPNOU 43584182, 08131, Kyiv region, Sofiyivska Borshchahovka village, Prospect of Heroes of the Heavenly Hundred bud. 16/22, apt 166, which carries out charitable activities through the Site.

Short version: These Terms are an agreement between us and our users. By using this Site, you agree to be bound by these terms and conditions and all applicable laws and regulations. You must be capable.

These Terms and any rules posted on the Site, including our Privacy Policy, constitute the entire legally binding agreement between you ("you" or "user") and "From Heart UA", which regulates your use of the Site and the collection of charitable contributions through the Site.

By using the Site, you hereby represent and confirm that:

1. in accordance with the laws of your country, you are legally capable and have the right to enter into this agreement;

2. the laws of your country do not restrict your use of the Site;

3. You comply with these Terms and the applicable legal requirements.

Activities «From Heart UA»

Short version: Website «From Heart UA» is intended for users who wish to make a charitable contribution or otherwise help the Foundation, as well as guardians of children, heads of children's centers, centers for the elderly in need.

Charitable Foundation «From Heart UA» since 2014, he has been helping orphanages every day. The chairman of the board of the fund is Morozov Alexander Alexandrovich. The Foundation is not owned by any of the political parties, commercial organizations or influencers and is funded by charitable contributions from individuals and legal entities.

Site From Heart UA — it is a tool for carrying out charitable activities in the following areas:

1. Assistance to orphanages.

2. Assistance to nursing homes.

3. Assistance to rehabilitation centers for ATO participants.

4. Single assistance to vulnerable segments of the population.

The Site is intended for users who wish to make a charitable contribution ("Donors") or otherwise assist the Foundation ("Volunteers"), as well as guardians of children, heads of children's centers, centers for the elderly in need of assistance ("Beneficiaries").

I want to help

Short version: You can make one-time and monthly charitable payments to the Fund through the Website. The funds received by the Fund are converted into assistance to children.

With the help of the Site, users can make charitable contributions in favor of the Foundation, which uses them in the above areas. You can make a one-time allowance or subscribe to a monthly payment for a specific amount, which can be canceled at any time using the settings in the Fondy payment system.

Also, users can make charitable contributions in the form of gifts to children or the elderly. A complete list of such gifts representatives «From Heart UA» will be sent to you upon request.

The Fund does not hold targeted fundraisers, instead the Fund purchases medicines, essentials, food, etc. orphanages and nursing homes at the request of the responsible person of such a house with which a cooperation agreement has been signed. The funds raised by the Fund are directed to the purchase of medicines, consumables, products, essentials, household appliances, payment for repair materials and repair work, plumbing and home appliances, furniture, gifts for the holidays.

All funds collected by our partners are transferred to the current account of the Fund or used on behalf of the Fund to pay for the services of foreign medical institutions provided to the Beneficiaries of the Fund.

Every year, the Fund submits to the tax inspectorate a report on the use of income (profits) of a non-profit organization.

Please note that payments through our Site are provided by a payment service provider that we do not control, namely Fondy. Once you follow the payment link, you must comply with the terms of use, privacy policies, and other policies of such providers. In no case shall the Fund be liable for payment data processed by such providers.

Please note that we do not control the exchange rate and commission that the bank may apply.

To transfer assistance through our Site, you must provide information about yourself. Learn more about how we process your personal data in our Privacy Policy.

Need help

Short version: Responsible persons for the operation of orphanages and nursing homes can apply for assistance from the Foundation.

Please note that the Fund provides assistance exclusively to citizens of Ukraine who are vulnerable segments of the population.

In order to contact the Foundation for help, please fill in the contact details on the relevant page of the Site. Information about the processing of personal data provided and your rights in this regard can be found in our Privacy Policy. The application will be processed by the Fund's employees within 3 working days.

If the Foundation approves your application, you will need to enter into a charitable agreement with the Foundation.

The Fund does not guarantee that you will receive the necessary assistance in full and within a specified time frame, as it depends on the charitable contributions provided by the Donors and the queue of Beneficiaries applying for assistance.

Volunteers

Short version: If you want to help children or the elderly with your own knowledge, skills or time, you can become a volunteer of the Foundation.

We invite children and the elderly to help not only with funds, but also with volunteering. In order to become a volunteer of the Foundation, please fill out an application for feedback on our Website. Our coordinator will contact you using the specified contact details and tell you how and when you can help the Foundation in charitable activities. First of all, the Foundation's employees will conduct an introductory briefing for you and, if necessary, additional training.

At your request, the Foundation enters into an appropriate agreement on the conduct of volunteer activities.

Third-party services and websites

Short version: When using sites and services that we do not control, you must comply with their terms of use and privacy policies.

Some functions of the Site, such as making a charitable payment, involve the use of third-party services and sites that "From Heart UA" does not control.

In case of problems, we will make every effort to solve them. However, we are not responsible for the content and functionality that may be offered on such sites or such third-party services, nor for any loss, damage or other monetary obligations arising from your use of such third-party sites or services.

Please note that other terms of use and privacy policies apply to your use of third-party sites and services. No way"From Heart UA» is not responsible for personal data processed by third-party sites and services.

Content and Intellectual Property

Short version: The Foundation owns the Site and all its content. We grant you certain rights to use the Site and content to the extent provided for in these Terms.

The site is owned and controlled by the Foundation. All materials of the Site, including texts, images, design, graphics, information, logos, audio and video recordings, interfaces, software, trademarks, trade names and others (the "Content"), as well as copyright and other intellectual property rights to such Content belong to the Foundation or are placed with the consent of the owner.

The Content, or any elements thereof, may not be used without the prior written permission of the Foundation or the respective owners in any manner not provided for in these Terms.

Subject to your compliance with these Terms, the Foundation grants you a limited, non-exclusive, revocable license, without the right to sublicense or transfer, to:

1. use of the Site from your personal devices under the conditions provided for in this document;

2. access to and view any Content posted on the Site or through the Site solely for personal non-commercial use.

As a result of downloading or creating copies of the Content, you do not receive any rights to such Content. You may not reproduce, publish, transmit, distribute, modify, create derivative works or otherwise use

The Fund is responsible for the use of charitable contributions in accordance with the current legislation of Ukraine.

However, we do not make any promises or guarantees, in particular, regarding the accuracy, usefulness, reliability and correctness of the Site. «From Heart UA" does not guarantee that the operation of the Site will be continuous or safe, that any defects will be corrected, or that the Site does not contain viruses or other harmful elements.

The Foundation is not responsible if any information, materials, content available on the Site are inaccurate or incomplete, as well as for typographical errors or shortcomings in the text or other materials.

In no event shall the Foundation, its founders, employees, contractors or volunteers be liable for direct, indirect, incidental, special, awarded or consequential damages related to the use or inability to use the Site, including, but not limited to, any damages arising from errors, omissions and interruptions in work, defects, viruses, even if the Foundation has been notified of the possibility of such damages.

The foregoing provisions for disclaimer of warranties and limitation of liability shall apply to the maximum extent permitted by applicable law.

Indemnification

Short version: You are responsible for your use of the Site. If you harm or dispute someone else, we will not participate in resolving it.

To the maximum extent permitted by applicable law, you agree to indemnify, indemnify and hold harmless "From Heart UA", our partners, employees, contractors and volunteers from any claims, liability, damages, damages and expenses, including reasonable legal and accounting expenses, in any way related to or arising from: 1. your violation of any of the provisions of these Terms, 2. your use / misuse of the Site, the content, features available on the Site, or 3. your violation of laws or the rights of third parties.

We reserve the right to choose the remedies we deem appropriate, including cases in which you release us from liability. Therefore, you agree to cooperate with us in implementing our strategy to protect your rights.

Governing Law and Dispute Resolution

Short version: This agreement is governed by the laws of Ukraine. We hope to resolve all issues peacefully, but in the event that a serious dispute arises between us, it must be resolved in the court of Ukraine.

Except as provided in these Terms or any other policies, these Terms are written and construed in accordance with the laws of Ukraine.

If any material on the Site or your use of the Site is contrary to the laws of your location, the Site is not intended for you and we ask you not to use it. You are responsible for reviewing and complying with the laws of your jurisdiction.

Any dispute, conflict, demand or dispute directly or indirectly relating to the Site or these Terms, in particular their validity, interpretation or application, shall be resolved through peaceful negotiations directly with the charity team "From Heart UA» in accordance with the principles of good faith and cooperation. If a consensus cannot be reached through negotiations, the dispute must be resolved exclusively in the courts of Ukraine, in compliance with the rules of jurisdiction, in accordance with the current substantive law of Ukraine.

All claims must be made within one (1) year of their occurrence, unless applicable law requires a longer period.

Electronic messages

By providing us with your e-mail through the Site, you understand and agree that we may send you notifications to the contact details you provide, in particular, 1. notification of updates on the Site; 2. information or materials relating to your use of the Site, charitable contributions and their use; 3. information regarding updates to these Terms.

You have the option to opt out of receiving electronic communications from us by following the instructions provided in such communications.

Miscellaneous

If any provision of these Terms is found to be illegal, invalid or unenforceable, the remaining provisions of these Terms will remain in effect and will be enforceable.

We may transfer our rights and obligations under these Terms to a third party, but this will not affect your rights or our obligations under this contract.

The printed version of these Terms is admissible evidence in judicial or administrative proceedings arising on the basis of or in connection with the use of the Site, to the same extent and under the same conditions as other business documents and records that were created and stored in printed form.

We reserve the right to make changes to these Terms at any time. In the event of a material change that may affect your use of the Site or your rights as a user of the Site, we will notify you of such changes within a reasonable time before they take effect by posting a corresponding notice on the Site or sending you an e-mail.
